A trust is a fiduciary relationship whereby property is held by one party, the trustee, for the benefit of another, the beneficiary. There are two basic types of trusts namely:

  • A living or inter vivos trust which is set up during a person’s lifetime
  • A testamentary or mortis causa trust which is set up in a will and only establishes after the person’s death
